1. WHAT'S IN THESE TERMS?

1.1 These terms tell you the rules for using our website https://www.covid19-testing.org (our site) whether you are simply using our comparison service (see 4 below) or are a business customer purchasing our services (together our “services”).


2. WHO WE ARE

2.1 https://www.covid19-testing.org is a site operated by Covid Testing Network Limited ("we", “our”). We are registered in England and Wales under company number 12678406 and have our registered office at 5-7 West Central, 127 Olympic Avenue, Abingdon OX14 4SA.


3. BY USING OUR SITE YOU ACCEPT THESE TERMS

3.1 By using our site, you confirm that you accept these terms of use and that you agree to comply with them. We amend these terms from time to time. Every time you wish to use our site, please check these terms to ensure you understand the terms that apply at that time.


3.2 If you do not agree to these terms, you must not use our site.


4. OUR COMPARISON SERVICE

4.1 Our comparison service is an online resource that strives to offer helpful content and comparison features to its visitors, enabling travellers to compare the price, availability and proposition of pre- and post-travel Covid-19 tests.


5. OUR RESOURCES

5.1 Our resources are provided based upon guidance produced on gov.uk at the time of listing. Additional conditions for entry may apply. You are solely responsible for checking all applicable requirements and restrictions in connection with your travel plans.


6. TEST PROVIDERS

6.1 All test providers added to our site appeared on the gov.uk list of providers of day 2 and day 8 testing, day 2 testing, test to release for international travel or general Covid-19 testing at the time of listing, and may appear on either a single government list or combination of lists. However, note that these lists as well as the Government’s general requirements and restrictions regarding international travel (for example, which countries are on the green, amber and red lists) are subject to change at any time and often on short notice. Therefore, whilst we aim to periodically check and update the information available on our site we do not guarantee its accuracy and you are solely responsible for checking all applicable requirements and restrictions in connection with your travel plans.


6.2 CTN Partners: CTN partners are test providers who have been verified by us (subject to 5.4 below) for accuracy of their listing on our Site including test prices and pay us a referral fee in accordance with 7 below. However, we are not and cannot recommend any particular test providers to you nor are we providing advice. By using our services, you agree to take full and sole liability for ensuring that the test provider you select matches your individual requirements. We recommend that you undertake your own research (for example, read reviews) about available test providers, the tests they supply and their terms and conditions.


6.3 Other test providers: Please note that we have not confirmed the details of the testing services (including but not limited to the accuracy of their listing and pricing) offered by other test providers on our Site who are not CTN Partners.


6.4 Test Pricing: We regularly update prices and details for all CTN Partners however these details are constantly changing and therefore you should check these details with the test provider you select. Prices on our site are a guide only and for comparison purposes, unless explicitly mentioned, are the cost of a single test inclusive of the sample collection kit, VAT and any applicable delivery charges. We do not guarantee the accuracy of any test provider’s listing on our site (in particular, the price of tests offered). We cannot be held responsible for any errors or omissions appearing on a test provider’s listing on our site. Please also note that test prices may vary depending on the turnaround time you select. We recommend that you visit the test provider’s website to learn more.


7. TEST BOOKING MADE DIRECTLY WITH PROVIDER

7.1 All test bookings are made directly with the test provider, under the terms and conditions of that provider and as such we cannot enter into communications regarding any individual test booking. We do not have access to any personal information relating to test bookings. The test provider shall be solely responsible for providing an end to end service to you in respect of the provision of all tests and results and we shall have no responsibility or liability in this regard


7.2 Please contact your test provider if you have questions about a test you’ve booked or taken, or if there are any issues with results or the service you expect to receive. We cannot process any complaints relating to tests and these must be taken up directly with the test provider.


7.3 If you have a complaint about a test provider, the Government advises you to email Test and Trace directly at [email protected] Please note, we do not own this inbox.


8. REFERRAL FEES

8.1 Whilst we do not charge you to use our comparison service, we do receive a referral fee from test providers which are labelled ‘Verified’ or ‘Trusted’ where a site user clicks through to their website. Certain providers may pay us a premium referral fee for promotional material appearing on their listing or placement within our search results.


9. SATISFACTION SCORES

9.1 For some providers we choose to display a satisfaction score. To the extent that a satisfaction score appears on our site, such score is determined by our proprietary methodology that aggregates social proof (e.g. online reviews) of a provider, our analysis of brand reputation and on rare occasions our subjective opinion.


10. WE MAY SUSPEND OR WITHDRAW OUR SITE

10.1 Our site is made available free of charge to the visitor.


10.2 We do not guarantee that our site, or any content on it, will always be available or be uninterrupted. We may suspend or withdraw or restrict the availability of all or any part of our site for business and operational reasons.


10.3 You are also responsible for ensuring that all persons who access our site through your internet connection are aware of these terms of use and other applicable terms and conditions, and that they comply with them.


11. HOW YOU MAY USE MATERIAL ON OUR SITE

11.1 We are the owner or the licensee of all intellectual property rights in our site, and in the material published on it. Those works are protected by copyright laws and treaties around the world. All such rights are reserved.


11.2 You may print off one copy, and may download extracts, of any page(s) from our site for your personal use and you may draw the attention of others within your organisation to content posted on our site.


11.3 You must not modify the paper or digital copies of any materials you have printed off or downloaded in any way, and you must not use any illustrations, photographs, video or audio sequences or any graphics separately from any accompanying text.


11.4 Our status (and that of any identified contributors) as the authors of content on our site must always be acknowledged.


11.5 You must not use any part of the content on our site for commercial purposes without obtaining a licence to do so from us or our licensors.


11.6 If you print off, copy or download any part of our site in breach of these terms of use, your right to use our site will cease immediately and you must, at our option, return or destroy any copies of the materials you have made.

12.1 Where our site contains links to other sites and resources provided by third parties, these links are provided for your information only. Such links should not be interpreted as approval by us of those linked websites or information you may obtain from them.


12.2 We have no control over the contents of those sites or resources.

13.2 Whether you are a consumer or a business user we do not exclude or limit in any way our liability to you where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence or the negligence of our employees, agents or subcontractors and for fraud or fraudulent misrepresentation.


13.3 If you are a business user only:
    13.3.1 We exclude all implied conditions, warranties, representations or other terms that may apply to our site or any content on it.
    13.3.2 We will not be liable to you for any loss or damage, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, even if foreseeable, arising under or in connection with:
    13.3.2.1 use of, or inability to use, our site; or
    13.3.2.2 use of or reliance on any content displayed on our site.

15. WE ARE NOT RESPONSIBLE FOR VIRUSES AND YOU MUST NOT INTRODUCE THEM
15.1 We do not guarantee that our site will be secure or free from bugs or viruses.


15.2 You are responsible for configuring your information technology, computer programmes and platform to access our site. You should use your own virus protection software.


15.3 You must not misuse our site by knowingly introducing viruses, trojans, worms, logic bombs or other material that is malicious or technologically harmful. You must not attempt to gain unauthorised access to our site, the server on which our site is stored or any server, computer or database connected to our site. You must not attack our site via a denial-of-service attack or a distributed denial-of service attack. By breaching this provision, you would commit a criminal offence under the Computer Misuse Act 1990. We will report any such breach to the relevant law enforcement authorities and we will co-operate with those authorities by disclosing your identity to them. In the event of such a breach, your right to use our site will cease immediately.

18. WHICH COUNTRY'S LAWS APPLY TO ANY DISPUTES?
18.1 If you are a consumer, please note that these terms of use, their subject matter and their formation, are governed by English law. You and we both agree that the courts of England and Wales will have exclusive jurisdiction except that if you are a resident of Northern Ireland you may also bring proceedings in Northern Ireland, and if you are resident of Scotland, you may also bring proceedings in Scotland.


18.2 If you are a business, these terms of use, their subject matter and their formation (and any non-contractual disputes or claims) are governed by English law. We both agree to the exclusive jurisdiction of the courts of England and Wales.
